
You wouldn’t steal a TV. You wouldn’t steal a DVD player. You wouldn’t steal an Xbox game. Why is it that you would steal intellectual property, or, rather, iPhone applications? Many people’s answer to this question is something close to this: “It’s too expensive, therefore; I want to ‘try’ it before actually buying it.” They also say that if they like the cracked version they’ll buy it. What if they don’t like the app enough to pay the developer’s set price, but they do like it enough to keep using it? They aren’t going to buy it. There are plenty of resources on the World Wide Web to let you know whether or not the app will sate your desire: YouTube, App Store app reviews, iPhone blogs, and more.
That quote plainly states what the FBI will do to you if they find you, and they aren’t going to take any excuses like, “I just wanted to try it first!” If you read the above quote thoroughly, you’ll notice “…including infringement without monetary gain…”. What that means is that if the use of pirated/cracked software is discovered you will be prosecuted even if you aren’t selling it; the fact that you are downloading the pirated apps makes you a criminal.
The fear of being arrested isn’t the only thing that should bother you, because you’re precious developers are at stake also. Abundant complaints are made due to the “outrageous and unreasonable” prices of potentially useful apps which is true, because you can easily find games on the App Store above $9.99, but that price is far below the cost of, let’s say, a Nintendo DS game. iPhone games are not your everyday cellphone games, and, due to the revolutionary accelerometer and touchscreen, you can hardly compare the two. As I said before, it is not only illegal; it is unfair to the developer to download cracked apps.
Imagine the following scenario: After years of zealous effort in an attempt to master your app developing skills, you pay the $99 to apply as an Apple iPhone developer. After downloading the iPhone SDK and spending endless nights concocting your own little version of Snake, you release it in the App Store with a price of $2.99. You don’t expect too many people to download your game due to the simplistic game-play at $2.99. Not a soul buys it, but instead downloads the cracked version. After looking to make a small income from this game, while it took you as much effort as it took a pro to make a better game, you failed to make money off of it.
The reason I used a simple developer as an example is that they are the ones who probably suffer the most. This does not mean, however, that big companies aren’t affected by this. If you use cracked apps, it is in fact to your disadvantage. I say this because most big developers sell their apps to make money, and once the flow of cash ceases to exist they have no reason to continue work on their app. That means there won’t be updates to your favorite apps if more people use cracked apps.
Downloading cracked apps not only makes you a criminal, it shows disrespect to all the masterful developers. Go ahead and stick with App Store; it’s the the right thing to do.









Hum… downloading apps from cydia or installer is not pirating the appstore apps, it’s third party apps, someone who offers a service for free, or for a fee… at no time are we downloading a pirated application, an illegal application. an application not recognise by apple doens’t make it illigal, does it?

But with pirated or ‘cracked’ apps from the appstore that are distributed free outside of the developer or apple.
i.e. those available through peer to peer or on some websites.
Installous is the main culpret, as it may be a third party app, but it gives you all you need to download and install cracked apps.
first off, xavier you are right, downloading a third party app and using it is not illegal. also, at least from what I understand, downloading and installing cracked apps is actually not illegal either. there is a technicality in the FBI statement. this is where the FBI gets tripped up: it’s only illegal if you “reproduce or distribute.” that means that you actually downloading it isn’t considered a crime, it’s when you use a program like a torrent downloader (which pretty much forces you to download and distribute programs at the same time) or are a person who has cracked this app or is somehow hosting a download for this app that you’re really committing the crime that the FBI goes after. what this means for joe schmo is be careful. also, it’s technically not illegal to download an app and crack it for yourself (just like it’s not illegal to have backup copies of xbox games or movies). it’s a fine line i guess, and i’m not advocating downloading, uploading, cracking or whatever, but just so everyone is aware of the technicalities.
all that being said, cracking an app probably does go against the user agreement you signed when you installed itunes/download things.

back when I was a WinMob user,I had many MANY trial versions of things on my phone.If I liked the app,I would buy it,but most of the times some of these apps were priced alittle steep,that it wasnt feasible to pay 49.99 for a program.Now that ive switched to the iPhone,cracked apps are something I dont even consider.Another thing I get leary about,apps on the app store that do not have a simple trial version.Now im not sure if app purchased from there have any sort of return policy is it is in fact trash,but wouldnt you want to test something before you buy?
Reviews alone on the app store,cannot be trusted alone in ones decision to purchase an app.I think if devs were serious enough about their apps(serious enough to charge 2.99+),and wanted to show everyone just how good they are,they would offer trials(in reference to an article on here a few days back).Theres ALOT of trash apps on the app store that have a price,but no trial,and people buy them,hate them,and are out the coin they spent.Sure it may not be alot,but its the principle that im referring to.

Let me remind EVERYONE that jailbreaking breaks the the DMCA rights law and has similar penalties to piracy. The ones who make these rules put us all in an unsavoury category, and it’s gone too far. All apps in the app store SHOULD be available for demo use for the individual to choose if they find it worthy. Where are we heading when we make criminals of people who may just be curious??????

I think we are just using todays technology to our advantage. Its the same as back in the day when you would call the radio station and request a song then sit by the radio waiting so you could record it on your tape player.

Most people buy the cheap stuff. I mean honestly, $3 isn’t much, and those who can’t afford it shouldn’t be using an iPhone in the first place, I mean that right there is $400-$700 (whatever it is now). Plus the plan on it is a lot.
Mostly, it’s big, expensive programs like Photoshop, Maya, Flash, and even PC games that get targeted, because not everyone has the $1k – $10k in their bank accounts, so people torrent/download those thinking “Well i just want to learn and not make money off of it so it’ll be okay.” well reguardless if you don’t make money or not, it’s still illegal.
What those companies should do is not charge an arm and a leg for that type of software, or, make a Personal edition which has the basic functions and nothing too advanced for like $200 – $500 for poor people, like myself, who can actually afford it and would like to learn how to use it for personal use (or for random, let’s say, flash videos for other’s entertainment.)
The iphone is your property the second you pay for it and you should have the right to do what you want to it. Yes it might be illegal to download cracked apps but, honestly, Who wants to pay the money when you can get it for free. Someone who downloads pirated apps is like someone who steals a bottle of coke. Their morals are messed up – just because its on the computer, you most likely won’t get caught and in the end its all just 1′s and 0′s doesn’t mean that you should do it.
While I do not condone piracy, I can understand why people do it.
Give the people a way to try the apps, maybe a limited trial period or maybe cut-down versions of the apps so you get an Idea what you are paying for. If Apple is not going to give the Customers that, I don’t see how they plan to stop people to pirate the Software from the AppStore.

if somebody pays 200+(depending what idevice it is) i think the y should be allowed to use cracked apps i do not use them but pepole who do use them at your own risk (nothing really ever does happen)

Its not actully illegal because the fbi states using anothers property to make you profit is illegal but once you buy the ipod/iphone its yours legally and you are getting one of the infinete copys of the application so the apple license aggrement is a legal contract but thats for your apple acount not you as an individual or any one person who uses your account so i conclude it is legal because all contracts or fbi statement has a loophole

Actually, johnti, the 5 years-$250,000 is the basic copyright statement found in all movies, cd’s, etc. before you actually play your content.
Installous allows you to get an app from someone who left it in a pubic-media website, say fileshare(it may be a real site but I just made one up for my purpose). On that site they give you the option of making an account and paying a monthly fee for a better download experience. So you could- technically- pay for it that way. Though for the most part, it’s like a friend gave you an app they downloaded to put on your device. Why is that illlegal?
First of all apple can’t stop you from jail breaking your device because when you jailbreak it’s similar to changing settings on your pc or changing your OS. Also the developers aren’t going to starve because you didn’t buy their app the bastards get money from other sources like companies that want to advertise through their apps they pay a lot to do that another thing those apps aren’t technically the property of the developers or companies if they are putting them out there to be downloaded I believe the apps should be free to the people who know how to jailbreak and get them
